A form called ‘a divorce petition’ is received by you usually from the court.
We will go through the divorce petition with you and the implications of it and then help you fill in the acknowledgement form (also known as the D10 form) saying your interests will be protected on other aspects such as finance and children.
The District Judge will check all the paperwork to establish that your husband/wife has proved grounds for divorce. If this is the case the Court will then give a date for when decree nisi of divorce will be pronounced.
Sometimes the Respondent is asked to pay a large part of the divorce costs of their husband/wife. We will help you through this. It is possible to attend Court to argue the point but this is not included in the fixed fee.
6 weeks and 1 day later, provided there were no problems, your husband/wife can quickly make an application for the Decree Absolute which is the paper legally declaring the final end to the marriage.
When Decree Absolute is received from the Court, we will check it for you provided you send it to us and then advise you about issues that then arise such as making a Will or updating one if you already have one.

Each fee will be on a case by case basis depending on the issues, the complexities involved, volume of paper work and the length of the case.
In most cases the above follows through without difficulty. In some cases there can be additional issues to be resolved and we do charge extra for this additional work, examples can be: sorting out a financial agreement, advice on contact to children, not being able to trace the other party, the other party denying receipt of the papers, needing to obtain a private detective and so on. Any extra costs will be discussed and agreed with you before any work is undertaken.
An example of an extra cost is e.g. you not having the original marriage certificate in which case we will then need to obtain a certified copy of your marriage certificate. Without this your Divorce Petition will not be accepted by the Court for issuing.
